Divorce in Türkiye is not only a personal issue between two spouses.
It is also considered a legal process connected to public order, financial consequences, child welfare, and long-term obligations.
And in practice, the dispute itself is usually much bigger than the divorce petition.
Custody, alimony, compensation claims, property division, residence issues, international recognition of judgments, and child-related conflicts often become part of the process very quickly.
Once foreign nationality, dual citizenship, assets abroad, or international relocation issues enter the picture, things may become significantly more complicated.
Main Grounds for Divorce Under Turkish Law
Turkish Civil Code recognizes limited legal grounds for divorce, including:
adultery
serious misconduct or violence
criminal or dishonorable lifestyle
abandonment
mental illness
irretrievable breakdown of the marriage
In practice, the most frequently used ground is usually the irretrievable breakdown of the marriage under Article 166 of the Turkish Civil Code.
Mutual consent divorce is also possible if:
the marriage lasted at least one year
both spouses agree on all legal consequences
a written settlement protocol is submitted to the court
And honestly, sometimes the worst settlement still creates less damage than the best long-term conflict.
Contested vs. Mutual Divorce
A mutual divorce may sometimes be finalized within a few months.
A contested divorce may continue for several years, especially if appeals, custody disputes, foreign elements, or property-related claims become involved.
The court process may include:
witness hearings
social investigation reports
expert evaluations
financial reviews
electronic evidence
property investigations
custody assessments
And yes, family court files can become emotionally exhausting surprisingly fast.
Custody, Alimony & Compensation
Turkish courts mainly focus on the best interests of the child when deciding custody matters.
Alimony claims may include:
temporary support during litigation
child support
spousal support
family assistance obligations
Compensation claims may also arise depending on fault, economic damage, and violations of personal rights.
Unlike some jurisdictions, Turkish judges have very broad discretion when determining amounts. Which means documentation, consistency, credibility, and overall presentation in court may seriously affect the outcome.
Property Division
Property division lawsuits are often financially more important than the divorce itself.
Under the default Turkish marital property regime, assets acquired during the marriage may become subject to division after divorce.

Court costs, translations, expert fees, enforcement procedures, and related expenses may also increase during the process.

Practical Reality
Family court litigation is rarely only legal.
It usually becomes emotional, financial, psychological, and sometimes international at the same time. And once children, property, or cross-border issues become involved, mistakes made early in the process may continue affecting both sides for years. The practical goal is not simply winning the divorce. The real goal is protecting your future life structure once the process finally ends.
